That was the week that was - The Royale with Cheese

royalecheese.jpgLooking at my Google Reader I realised that there have been a series of posts by law bloggers in the last week that are property-related so I thought I would do a quick round-up and link-fest.

On the obligatory Nearly Legal blog we have an analysis of the "Royale with cheese" conundrum [read the blog post to see what NL means] illustrated by the ECHR case of Zehentner v Austria.

The case demonstrates the difference in approach to mandatory rights to possession between the ECHR and the House of Lords. NL asks how long before the new Supreme Court is required to revisit this issue. "Should the Supreme Court now be dealing with Royales with (or without) cheese or remain wedded to their quarter pounders?" NL asks.

Family Lore's interest has been irrevocably tweaked by the ongoing court saga between property fixer Scot Young and his estranged wife Michelle Young here.

Tessa Shepperson of The Landlord Law Blog discusses here a recent case (Hunt v Hussesin, Epsom County Court) that appeared in the housing section of the Legal Action Magazine, which should serve as a warning to landlords tempted to lock out their tenants.

The Husseins had forcibly evicted Mr Hunt by changing the locks and refusing to let him back in again. Mr Hunt's ensuing three months of homelessness had a devastating psychological effect on him and the court awarded him £56,678 in damages. Ouch.

While Rowena Meager's Property Law Blog discusses here the High Court's decision in MacDonald v Frost [2009] EWHC 2276 (Ch) that revisited the topic of proprietary estoppel and acknowledged that Thorner v Majors is now to be regarded as the leading modern authority on proprietary estoppel.

Over the puddle, the Wall Street Journal's brilliant legal blog discusses here a legal battle in New York over the Atlantic Yards project, a controversial plan to build an NBA arena (for the New Jersey Nets), along with stores and condos in an area of Brooklyn that has been designated as blighted.
