dinosaurs.jpgWith the pre-Christmas rejection by the Court of Appeal of LandSec's £17m abuse of process claim against Fladgate the property giant may have hit upon an alternative way to get back at the law firm.

The legal claim was brought after Fladgate sought to bring a judicial review challenge to LandSec's Park House scheme near the law firm's West End office.

LandSec alleged that Fladgate had committed the tort of abuse of process by using judicial review to further its commercial interests.

The Court of Appeal unanimously held that Fladgate had been entitled to seek to protect its interest in and enjoyment of its property by bringing judicial review proceedings to challenge the planning application in respect of nearby property.

With that defeat LandSec is now set to open a Dinosaurs Unleashed exhibition at the Park House site ahead of building works.

A source close to LandSec said: "It should be amazing. Apparently, they are trying to teach them to feast on law firms."
