Employment agencies and employment businesses
If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act') it is your responsibility to ensure that the use you make of information from our candidate database complies with your obligations under the Act and the various regulations made under it, together with any applicable guidelines. These regulations are currently contained in the Conduct of Employment Agencies and Employment Businesses Regulations 2004. You agree to comply with the Act and these regulations as they affect the conduct of your business and the use you make of information on our candidate database.

Rights in the database
Database rights and all other applicable copyright and intellectual property rights in the candidate database belong to Reed Business Information Limited. You acknowledge that you do not acquire any rights in the database or its content and that your retention and use of the database and its content is governed by these terms and conditions.

Use of the database
The material you are entitled to receive from the candidate database is determined by the product you have purchased from us. On receipt of this material you may:

i. Use, search or download it to your database for the purpose of finding suitable candidates for specific job vacancies that you or (if you are an employment agency or employment business) your client wish to fill.

ii. Use the information about the individuals contained in the database for the purpose of contacting them (either directly or through us depending on the product you have purchased) in relation to a specific job vacancy.

iii. Use the information only in connection with your own recruitment-related activities.

You may NOT:

i. Supply, sell or license material from the candidate database, or a copy of it, to any other person, including another member of your group of companies.

ii. Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of finding suitable candidates for specific job vacancies.

Online services (each a ‘Service’) from estatesgazette.com are provided subject to the following terms and conditions. These terms and conditions apply to use of each Service and the materials and information it contains (‘Materials’) by persons authorised to do so.

In these terms and conditions, an Authorised User is an individual; (i) who has entered into a subscription agreement with EGi for the relevant Service; (ii) who is a named employee of a company or other organisation which has entered into a subscription agreement for the relevant Service (a 'Subscriber’); or has otherwise specifically been authorised by EGi to access the Service, in each case where a password has been issued to that individual by EGi.. References to an Unauthorised Person means any person who is not an Authorised User. No Unauthorised Person is entitled to access or use any Service or Materials.

A Service may contain additional terms and conditions applicable to specific activities or sections of the Service ; for example, access to discussion forums and community areas. By participating in such activities Subscribers and Authorised Users accept the terms and conditions applicable to the relevant section of the Service.

Subscribers are responsible for procuring that their Authorised Users comply with these terms and conditions. EGi may suspend access to a Service to a Subscriber or an Authorised User (at its discretion) at any time without compensation if there is evidence of a breach of these terms and conditions

Licence

Authorised Users and Subscribers may use the Service and the Materials that appear on it from time to time for their own private or business research, and for this purpose may:

a. display the Materials on screen;

b. make printouts of items included in the Materials using the printing commands contained in the Service

c. download and store in machine readable a single copy of insubstantial portions of the Materials primarily for one person’s exclusive use; and

d. incorporate insubstantial parts of the Materials in to reports and other documents created for the purposes of their business or research, provided that the source of the Materials is clearly credited.

Restrictions on Use

Authorised Users and Subscribers may not:

a. make multiple printouts or copies of Materials for distribution to Unauthorised Persons;

b. re-sell the Service or any part of the Materials to others;

c. save as authorised by Section 1 above, abstract, download, store, reproduce, transmit, display, copy, distribute or use the Materials or make the Service or any Materials available to Unauthorised Persons by any means, including but not limited to a local area network, a wide area network or on any intranet or extranet;

d. decompile, disassemble or reverse engineer any of the computers, software programmes, databases or other systems used by EGi to provide the Service; or

e. use the Service for any illegal purpose nor send or post or allow any posting of information which is defamatory or obscene or which violates the legal rights of others, nor use the Service to send any unsolicited promotional or advertising material, or any volume messages which may interfere with the provision of the Service or the enjoyment of the Service by other users. 

Passwords and Security

Passwords may be used only by the individual to whom they are issued and may not be used to make the Service or Materials available to Unauthorised Persons. EGi may cancel or suspend any password that it suspects is being used in breach of these terms and conditions.

 Content

a. Materials and features may be added to and removed from the Service without notice.

b. The Materials and information included in the Service are provided for reference purposes only. They are not intended either as a substitute for professional advice or judgement or to provide legal or other advice with respect to particular circumstances.

c. Subscribers and Authorised Users should obtain independent verification or advice before relying on any piece of information in circumstances where loss or damage may result.

d. The Service and Materials are provided on an ‘as is’ basis and EGi excludes to the extent permitted by law all implied warranties relating to fitness for a particular purpose.

Intellectual Property Rights

a. All intellectual property rights and other rights in the Service and Materials (in both machine readable and printed form) belong to EGi or their third party licensors. Authorised Users and Subscribers acquire no proprietary interest in the Service or Materials and except as expressly permitted by these terms and conditions and may not use the Service or the Materials in any way that infringes the intellectual property rights in them.

b. Authorised Users and Subscribers may not obscure or remove any copyright notices that appear on Materials printed from the Service.

Limitation of Liability

a. The total aggregate liability of EGi in connection with the use of the Service or Materials (other than for death or personal injury caused by our negligence) shall not exceed the actual direct damages, excluding any loss of profit or loss of business suffered by the Subscriber, or the amount paid by the Subscriber for the Service, during the annual subscription period in which the damage occurred, whichever is the lesser. EGi shall have no liability for indirect or consequential loss or damage.

b. The liability of EGi for interruptions to availability of the Service caused by circumstances within its control shall not exceed the amount paid by the Subscriber for access to the Service during the period of non-availability. The only obligation of EGi in respect of interruptions caused by circumstances outside its control shall be to use all reasonable efforts to have the Service reinstated.

Law and Jurisdiction

These terms and conditions shall be interpreted in accordance with the Laws of England and any dispute shall be subject to the exclusive jurisdiction of the English Courts. As at 1st February 2012, these terms and conditions apply to all new Subscribers and to all renewal Subscribers from the date of their renewal.
